Your use of BanyanDNA is subject to the terms detailed in this document. Please read this document carefully and make sure you understand everything it entails. If you do not understand or accept any part of it, then you may not use BanyanDNA's services.
Any information or material provided by BanyanDNA via our website or web application is for informational purposes only. We offer no warranty of any kind, express or implied, regarding the accuracy, validity, or availability of any information on our website or web application.
You may use BanyanDNA's offerings only for lawful purposes. By visiting our site or application, you hereby agree not to use the offerings:
You may deactivate your account at any time by emailing us at support@banyandna.com. Please refer to the Subscriptions, payments, and refunds section for details on your subscription or payment status after account deactivation.
BanyanDNA may suspend or terminate your BanyanDNA account at any time for any reason. We will terminate your account if we believe you have breached the terms of this agreement.
The visual interfaces, graphics, data, code, products, services, and all other elements of the services ("Materials") provided by BanyanDNA are protected by intellectual property laws including copyrights, patents, trademarks, and other rights. All Materials provided by our services are the property of BanyanDNA.
The user is allowed to temporarily download one copy of the Materials for viewing purposes only. There are no other implied licenses for any Materials provided by BanyanDNA; you may not copy, modify, republish, or transmit any Materials without BanyanDNA's express written consent except as expressly provided in these Terms.
The user agrees to complete payment for any order made from the user's account in accordance to the prices posted at the time the order was placed. The user also agrees to pay all applicable fees and taxes associated with their order. By placing an order, the user authorizes their chosen payment method to be immediately charged the full amount specified in the order. The user also agrees to share transactional information with our payment processors for the purpose of fulfilling your purchase. If a payment method is invalid, the user's order may be canceled.
The user agrees to allow their selected payment method to be charged again at the time of renewal for any active subscriptions associated with the user's account. The user may cancel their subscription at any time via the billing portal. If the user chooses to deactivate or delete their account, their subscription will continue for the remainder of the current subscription's term.
Refunds are processed on a case-by-case basis. Generally, we will grant refunds for subscriptions purchased within 2 weeks of the order being made.
BanyanDNA is not responsible for the content hosted on any site that is linked on our web site or web application. BanyanDNA does not provide any endorsement for any linked site or the content hosted on said sites. Use of any linked site is done at the user's own risk.
This agreement is governed by and enforced in accordance with the laws of the State of Utah and the larger United States of America. Any legal suit or action related to your agreement to these Terms shall be instituted in the federal courts of the United States or the courts of the State of Utah. By agreeing to these Terms, you consent to personal jurisdiction and venue in these courts.
BanyanDNA reserves the rights to change these Terms at any time without notice, though we will notify you of any major changes to these Terms via the email address associated with your account. By using BanyanDNA's website or web application or other services, you are agreeing to be bound by the most recent version of the Terms.
